These days, there is more than one way to have a will prepared. While most people will have a lawyer assist them, some are turning to the many online services that allow you to prepare a will yourself. These online options are the modernized version of the forms you could once buy at your local store. While they may seem convenient, these online will services do not provide any legal advice when questions arise nor do they provide any assistance in ensuring that your estate will be distributed in the way you wish or in the most tax efficient manner.
There is a way, however, to combine the convenience of preparing your will from the comfort of your own home while still ensuring your wishes and needs are met. Having a lawyer draft and duly execute your will does not actually require that you meet with them in person.
As long as your lawyer can take your instructions and properly advise you, executing a will in BC only requires that your signature be witnessed by two people (neither of whom should be your executor or a beneficiary). As of 2021, your signature can also be witnessed via videoconferencing.
Even confirming your identity, which is required if you are not meeting in person with your lawyer and they are not witnessing your signature, can be confirmed through a variety of online methods including the Land Title and Authority’s new Contactless Identification Verification service.
